Dove Cammer Kits "LAW SUIT"

December 4 2008, 7:44 AM

Don't buy a Dove Cammer Kit. There is a Law suit pending right now!!!

I have heard that there are 10 or 11 kits out there, if any of you want your money back, I suggest you send me your information at rgordon@watchtv.net and I will forward it to the guy that is pressing the law suit. A combined suit action would be more effective and cheapen the cost for all involved.

I will most definately post more on this here to the list as I get permission to be able to share more.

Again, anyone who is not happy with their Dove stuff, please send me a shout and I will forward it.

Again... rgordon@watchtv.net Roger

If a lawsuit has been filed, it is public information...

December 4 2008, 7:51 AM

Roger, can you provide a link to the public filing?

Suit

December 4 2008, 4:44 PM

If one is filed it would have to be in area where Dove's place of business is. If I was curious enough I would look there, RWJ

Are you sure about that?

December 4 2008, 6:53 PM

My understanding is that you can file a suit anywhere you want. At least in Minnesota small claims court, I could file a suit against anyone in courts here, regardless of their location.

I think if there has been a suit filed, it could be anywhere. I've already done a search and haven't found anything. My guess is that there is no suit filed, although there may be parties considering filing one...

Law Suits

December 5 2008, 5:14 AM

Jay,

Small claims and regular law suits are two different animals. In Ohio, which we all know where this problem orriginates from, I believe there is a cap on small claims of $5,000. I could be wrong on that, but that is what I believe.

Being as this is over $14,000 per kit, I don't think it is small claims.

As far as small claims in Ohio, I do know this from personal experience, You have to file your case against a defendant in HIS jurisdiction UNLESS you can prove that he has advertised in your juridiction such as Doves advertisements in national magazines and on line site.

If you prove the defendant advertisements were available to you locally then you can file locally and you will win your case automatically by default if they don't show up for the case, but then you still have to register your win verdict in the defendants jurisdiction.

I have a copy of Doves disclaimer of liability policy on his products that was sent to the attourney general on this matter, so the ball IS rolling.

Funny, I never saw a liabillity disclaimer on his web site, in his magazine adds, or in his shop on the premisses when there, so I wonder how that flies??

You can bet your ASS, I will post a copy of it when and if the complaintent says I may, plus any updates I am told of as permission is granted. I in no way want to hamper this guys law suit, and hope others who have shelved their kits will have them propperly inspected as I feel there are probably a few that have been shelved.

Roger

Just be careful Roger. If you are posting these these things on a public forum

December 5 2008, 5:33 AM

You can open yourself up to slander and defamation if the law suit does not fail or is dismissed. Use terms like "alleged" and "possible" alot. Remember, innocent until proven guilty. Even then, a vigilant lawyer can get you as a third party agitator. Friendly advice, but stick to court record references. It would be best to have the lawyer who is handling the suit to sent out solicitations to join in a class action suit. They have E&O malpractice insurance if they happen to get something wrong.

I'd hate to see you get slapped with a suit for just being the messenger, do word things carefully and be sure you are just reporting proveable facts.

I'm so happy I didn't sell those kits, it seemed like the project would be a thankless task. RWJ

Did everyone not know that this was going to happen

December 6 2008, 7:23 PM

I saw this coming and knew that the stuff would not work. It is amazing what some people will try to sell before they even test the stuff or even check it out. Good luck, Keith Craft

Bill,

Thanks for your input. My brother and his wife are both attourneys. Two local Judges are personal friends of the Family, one Judge wrote my brothers recomendation letter and is the father of my brothers best man.

I told the complaintant to check with his attourney, and wont release anything I have been shown until he states his attourney says it is ok.

I still think what you stated is good sense and in future will post it as a point of intrest without comment (thought some might want to see this) type of post and let others make up their own mind.

Funny, Ken S. hasn't had anything defensive to say, or did he do much to help the guy (that I am aware of) when I produced one of "those immaginary people".

I just don't want anyone else to get burned by anyone who seemingly does not care about product quallity or customer satisfaction.

Roger

Good deal. Our legal system has gotten screwy.

December 6 2008, 2:17 PM

I wound up dragged into a rent dispute once on the side of a neighbor I didn't really care for just for expressing general sympathy over their plight. Next thing you know I am in court answering questions about that person and the landlord thinking, Godddamn how did I end up in the middle of this? happy.gif

I will make a nuetral statement here, that if anyone has been taken advantage of on a purchase from the named vendor, contact your state Attorney General's office and if there is a civil action, any blanket solicitations, from other states you will be notified. To prevent a defendant from getting traction the best way is to avoid any appearance of collusion outside the system of civil solicitation. It also prevents the defendant's side from shilling up satisfied references. Once your name goes on the list, it puts you at risk for countersuit action. In the case of the rent dispute I actually just from opening my big mouth was on the shit list on a countersuit against someone (the renter who lost the dispute) that I just really I wish I had never even spoken to. happy.gif It all got thrown out, but day'um!
